Welcome to Sunset Charters HB. By accessing or using our website and services (collectively, the “Service”), you agree to comply with and be bound by these Terms of Use (“Terms”). Please read them carefully. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You represent that you are at least 18 years old; use by minors is not permitted.

2. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not violate any applicable laws, engage in unauthorized access to the Service, disrupt its operation, or transmit harmful, fraudulent, or malicious content. We may terminate or suspend your access at any time for violations of these Terms.

3. Accounts

Certain features may require creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, and you agree to provide accurate and complete information.

4. Bookings, Payments & Cancellations

Charter bookings are subject to availability and confirmation. Payments may be processed through a third-party payment provider (Zoho Secure Pay), subject to that provider’s terms. Deposits, cancellation, rescheduling, and refund terms, along with any weather-related policies, are set out in your booking confirmation or separate charter agreement, which govern your reservation. Prices are subject to change until a booking is confirmed.

5. Safety & Assumption of Risk

Boating and on-water activities involve inherent risks. All guests must follow the instructions of the captain and crew at all times. For everyone’s safety, the captain has sole authority over the vessel and may modify, shorten, delay, or cancel a charter due to weather, sea conditions, safety concerns, or guest conduct. Participation in a charter may require agreeing to a separate waiver and assumption-of-risk agreement, which is in addition to these website Terms.

6. Intellectual Property

All content on the Service, including text, graphics, logos, images, and software, is the property of Sunset Charters HB or its licensors and is protected by applicable laws. You may not copy, reproduce, distribute, or create derivative works without prior written permission.

7. Third-Party Links

The Service may include links to third-party websites or services. We do not control, endorse, or guarantee their content, services, or privacy practices, and you access them at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, Sunset Charters HB and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages, including loss of data, profits, or (except as required by law) personal injury arising from your use of the website. Our total liability for the website shall not exceed the amount you have paid to us for the Service or $100 if no purchases have been made. The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. (Liability relating to the charter itself is addressed in your separate charter agreement and waiver.) Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Privacy

Your use of the Service is also governed by our Privacy Policy and California Privacy Act Policy, which explain how we collect, use, and protect your personal information.

10. Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in California.

11. Changes to Terms

We may update these Terms from time to time. Changes will be effective upon posting with an updated effective date. Continued use of the Service constitutes acceptance of the updated Terms.
